Me and a colleague are looking to create two old 8bit games for the IPhone. These games are nearly approaching 25 years now, and I'm wondering what's the deal on licencing or some kind of royalty system? Are there any games out there that have been redone and there's no deal with paying the originally crew/person that created the game, or publishers (if they even exist still)?

Copyright will still exist on them. While many have been made available for free distribution, there's usually a 'not for profit or commercial gain' clause that prevents them being put on sale. You'd need to find the copyright holder (not always the original author) and obtain permission.
